Terms of Use

These Terms of Use ("Terms") govern your use of MonClips, including the MonClips mobile application, monclips.com, public MonClips portfolio pages, and related services (collectively, the "Services").

The Services are provided by MonClips Inc., a Delaware corporation ("MonClips," "we," "us," or "our").

By creating an account or using MonClips, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. MonClips

MonClips is a portfolio platform that helps creators and professionals organize, present, and share their work.

The Services may allow you to create a portfolio, organize work into albums, upload photos and videos, create a personal portfolio link, add contact and social information, share your portfolio, and view portfolio analytics.

MonClips does not guarantee employment, clients, contracts, revenue, or any other particular professional or business result.

2. Your Account

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or purchase a subscription.

You are responsible for providing accurate information, keeping your account secure, and for activity occurring through your account.

You may not impersonate another person or use information you are not authorized to use.

We may change, reclaim, or disable usernames or portfolio URLs that violate these Terms, infringe third-party rights, impersonate others, or interfere with the Services.

3. Public Portfolios

MonClips is designed to let you publicly share your portfolio.

Information you publish may be accessible to anyone with your portfolio link. This may include your name, profile photo, bio, specialization, albums, photos, videos, social links, contact information, and other information you choose to publish.

You are responsible for deciding what information you make public. Do not publish confidential or sensitive information that you do not want others to access.

4. Your Content

You retain ownership of the photos, videos, text, projects, and other content you upload to MonClips ("User Content").

By uploading or publishing User Content, you grant MonClips a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, optimize, transmit, and display your content only as reasonably necessary to operate, maintain, improve, secure, and provide the Services.

This allows us, for example, to store your files, generate previews, optimize media for different devices, and display your work to portfolio visitors.

MonClips does not acquire ownership of your User Content.

You represent that you own your User Content or have all rights and permissions necessary to upload, publish, and display it.

You may not upload content that is unlawful, infringes third-party rights, contains malware, exploits minors, or otherwise violates these Terms.

We may remove or restrict content that violates these Terms or applicable law.

5. Portfolio Analytics

MonClips may provide analytics showing how people interact with your portfolio.

Analytics may include portfolio views, visitors, content views, engagement, approximate location, devices, traffic sources, and contact interactions.

Analytics are provided for informational purposes and may contain estimates, delays, or inaccuracies. We do not guarantee that analytics will always be complete or error-free.

6. Subscriptions

MonClips currently offers:

• Monthly — $9.99/month
• Yearly — $49.99/year

Subscriptions are purchased through the Apple App Store or Google Play. MonClips does not currently sell subscriptions directly through its website.

Prices may vary by country, currency, taxes, or marketplace pricing. The price displayed by the applicable app marketplace before purchase is the price that applies to your subscription.

Subscriptions automatically renew until canceled.

Apple and Google may apply their own terms and policies to your purchase.

7. Free Trial

Eligible users may receive a 7-day free trial.

Unless you cancel before the trial ends, your subscription will automatically convert to the plan you selected and your Apple App Store or Google Play account will be charged the applicable subscription price.

The price and billing period will be displayed before you confirm your subscription.

Trial eligibility may be determined by Apple, Google, or MonClips.

8. Renewal and Cancellation

Monthly subscriptions renew monthly and yearly subscriptions renew annually unless canceled.

You may cancel your subscription through the Apple App Store or Google Play, depending on where you purchased it.

Cancellation prevents future renewals. Unless otherwise required by applicable law or marketplace rules, you will retain subscription access until the end of your current paid period.

Deleting the MonClips app does not cancel your subscription.

9. Refunds

Payments and refunds are handled through the Apple App Store or Google Play and are subject to the applicable marketplace policies and applicable law.

Nothing in these Terms limits refund or consumer rights that cannot legally be waived.

10. When Your Subscription Ends

When your subscription or free trial ends without renewal, access to paid MonClips features may be restricted.

We will generally retain your portfolio and User Content for 90 days after your subscription access ends.

During this period, you may renew your subscription to restore access to retained content.

After 90 days, your portfolio and User Content may be permanently deleted and may no longer be recoverable.

You are responsible for keeping your own copies of important content.

Some information may be retained longer where reasonably necessary for backups, security, fraud prevention, legal compliance, financial records, or dispute resolution.

11. Acceptable Use

You may not use MonClips to:

• violate applicable law;
• infringe another person’s rights;
• impersonate another person;
• access accounts without authorization;
• distribute malware;
• commit fraud, spam, or abuse;
• interfere with the operation or security of the Services; or
• circumvent technical or security restrictions.

We may suspend or terminate accounts that materially violate these Terms.

12. Copyright

MonClips respects intellectual property rights.

You may only upload content that you own or have permission to use.

If you believe content on MonClips infringes your copyright, please contact [email protected] and identify the copyrighted work and the content you believe infringes it.

We may remove or restrict access to infringing content and may suspend or terminate accounts of repeat infringers.

13. MonClips Intellectual Property

The MonClips software, technology, interface, design, branding, logos, trademarks, and other materials are owned by or licensed to MonClips.

We grant you a limited, personal, non-exclusive, non-transferable right to use the Services in accordance with these Terms.

This does not transfer ownership of any MonClips intellectual property to you.

14. Privacy

Our collection and use of personal information are described in our Privacy Policy.

Because portfolios may be publicly accessible, please carefully choose what personal and contact information you publish.

15. Service Availability

We work to keep MonClips available and reliable, but we cannot guarantee uninterrupted, secure, or error-free operation.

We may update, modify, add, or remove features as reasonably necessary to develop, maintain, secure, or operate the Services.

16. Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, MonClips is provided "as is" and "as available."

We do not guarantee any particular number of portfolio views, clients, contracts, business opportunities, sales, revenue, or other professional results.

To the maximum extent permitted by law, MonClips Inc. and its directors, officers, employees, affiliates, and agents will not be liable for indirect, incidental, special, punitive, or consequential damages, including loss of profits, revenue, business opportunities, goodwill, or data.

To the maximum extent permitted by law, MonClips’ total liability arising from the Services will not exceed the greater of:

• (a) the amount you paid for MonClips during the six months preceding the event giving rise to the claim; or
• (b) US $100.

Nothing in these Terms excludes rights or liabilities that cannot legally be excluded or limited.

17. Governing Law and Disputes

These Terms and your use of the Services are governed by the laws of the State of Delaware and applicable federal laws of the United States, without regard to conflict-of-law principles.

If you have a dispute with MonClips, please contact us first at [email protected] so we can attempt to resolve it informally.

If a dispute cannot be resolved informally, and unless applicable law requires otherwise, any legal action arising from these Terms or the Services shall be brought in the state or federal courts located in the State of Delaware, United States.

You and MonClips consent to the jurisdiction and venue of those courts.

Nothing in this section limits non-waivable rights available under applicable consumer protection laws.

18. California Consumer Notice

California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs regarding complaints about the Services:

Nothing in these Terms limits rights available to California consumers that cannot legally be waived.

19. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will provide notice where required by law. The updated Terms will show the date of the latest revision.

Your continued use of MonClips after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

20. General

These Terms and our Privacy Policy constitute the agreement between you and MonClips regarding your use of the Services.

If any provision is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision does not waive our right to enforce it later.
